Terms of Service

By purchasing or using Fit3D for Trainers ("the Product"), published by VixApps ("we", "us", "our"), you agree to these Terms of Service. If you do not agree, do not purchase or use the Product.

1. The Product

The Product is a digital library of 3D exercise animations, images, and structured metadata (JSON/CSV). Upon purchase you receive an instant download link and lifetime access to the materials included in the package. The word "lifetime" applies to the life of the product, not your own lifetime. The average lifetime of a product of this nature, sold at this price point to be supported, is approximately 5 years. Once you download the files, you keep access to them indefinitely.

2. License & Permitted Use

The Product is sold under two license tiers. Your rights depend on which license you purchased, as identified by your order confirmation and receipt.

2a. Personal Use License

If you purchased the Personal Use license, you are granted a worldwide, perpetual, non-exclusive license to:

  • Use the animations in your own one-to-one coaching sessions and client training plans.
  • Use the animations on your personal or business social media and in your own marketing materials.
  • Import the metadata database for your own personal reference and record-keeping.

The Personal Use license does not permit embedding the animations inside any app, website, software product, or third-party coaching platform (e.g. TrueCoach, Trainerize), nor distributing the files or database as part of a paid deliverable, template, or product sold to others. For those uses, you must purchase the Commercial ("Pro") license.

2b. Commercial ("Pro") License

If you purchased the Commercial ("Pro") license, you are granted a worldwide, perpetual, non-exclusive license to:

  • Use the animations inside your own apps, websites, and software products.
  • Use the animations in client training plans, PDFs, guides, and other paid deliverables.
  • Use the animations on your social media, marketing, and advertising materials.
  • Use the animations for client deliverables via platforms such as TrueCoach and Trainerize.
  • Import the metadata database into your own CRM, database, or Notion workspace.

3. Prohibited Use

Regardless of license tier, you may NOT:

  • Resell, sublicense, redistribute or share the raw files, videos, or database with third parties.
  • Offer the animations as a standalone stock library or generic stock product.
  • Claim ownership of the underlying copyright of the animations.
  • Use the materials in any unlawful, defamatory, or misleading way.
  • Use a Personal Use license for any use reserved to the Commercial ("Pro") license under Section 2b.

4. No Refunds

Due to the digital nature of the Product, all sales are final and no refunds are accepted. By completing your purchase you acknowledge and agree that access to the Product is granted immediately after payment and therefore cannot be returned or exchanged. If you experience technical issues with your download, contact support@vixapps.com and we will help resolve the issue.

You understand and agree that this purchase is non-refundable. You expressly request and consent to the immediate delivery of the digital content and/or services upon purchase, and acknowledge that by downloading or accessing the product, you waive your right of withdrawal under EU Directive 2011/83/EU.

5. Delivery

Payment is processed securely by Paddle, our payment provider. Delivery is handled automatically: a download link is provided immediately after payment confirmation. If you do not receive your download link, contact support@vixapps.com.

6. Disclaimer of Warranties

The Product is provided "as is" without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Product will be error-free or that results from its use will be as represented in testimonials.

7. Limitation of Liability

In no event shall VixApps be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Product. Our maximum aggregate liability shall not exceed the amount you paid for the Product.

8. Health Disclaimer

The animations are for educational purposes and do not constitute medical or fitness advice. Users should consult a qualified professional before beginning any exercise program. We are not liable for injuries arising from exercise programs based on this content.

9. Intellectual Property

All rights, title, and interest in the Product remain with VixApps and its licensors. Your license does not transfer copyright or ownership of the animations or metadata.

10. Changes to Terms

We may update these Terms at any time. Continued use of the Product after changes constitutes acceptance of the revised Terms. Material changes will be communicated on this page.
